Vyplnen\u00edm kontaktn\u00e9ho formul\u00e1ra a\/alebo objedn\u00e1vky vyjadrujete obozn\u00e1menie sa a s\u00fahlas a zav\u00e4zujete sa riadi\u0165 (i) t\u00fdmito Obchodn\u00fdmi podmienkami ; (ii) ak\u00fdmiko\u013evek osobitn\u00fdmi podmienkami upraven\u00fdmi v&nbsp;jednotliv\u00fdch objedn\u00e1vkach a\/alebo obsiahnut\u00fdch vo vz\u00e1jomnej p\u00edsomnej komunik\u00e1cii (iii) v\u0161eobecne z\u00e1v\u00e4zn\u00fdmi pr\u00e1vnymi predpismi v&nbsp;zmysle OP. V&nbsp;pr\u00edpade nes\u00fahlasu s Obchodn\u00fdmi podmienkami alebo osobitn\u00fdmi podmienkami, nepotvrdzujte z\u00e1v\u00e4zn\u00fa objedn\u00e1vku.<\/p>\n\n\n\n<p>1.3.&nbsp;&nbsp;Objedn\u00e1vate\u013eom je ka\u017ed\u00fd n\u00e1v\u0161tevn\u00edk Internetovej str\u00e1nky, ktor\u00fd vytvoril z\u00e1v\u00e4zn\u00fa objedn\u00e1vku. Pre \u00fa\u010dely z\u00e1kona \u010d. 102\/2014 Z. z. sa spotrebite\u013eom rozumie fyzick\u00e1 osoba, ktor\u00e1 pri uzatv\u00e1ran\u00ed a plnen\u00ed spotrebite\u013eskej zmluvy nekon\u00e1 v r\u00e1mci predmetu svojej podnikate\u013eskej \u010dinnosti, zamestnania alebo povolania.<\/p>\n\n\n\n<p>1.4.&nbsp;&nbsp;Do zmluvn\u00fdch vz\u0165ahov so Zhotovite\u013eom m\u00f4\u017eu vst\u00fapi\u0165 fyzick\u00e9 osoby v\u00fdlu\u010dne star\u0161ie ako 18 rokov.<\/p>\n\n\n\n<p>1.5.&nbsp;&nbsp;Internetov\u00e1 str\u00e1nka a jej obsah patriaca alebo spravovan\u00e1 Prev\u00e1dzkovate\u013eom m\u00f4\u017ee by\u0165 aktualizovan\u00e1 kedyko\u013evek, bez predch\u00e1dzaj\u00faceho upozornenia.<\/p>\n\n\n\n<p>1.6.&nbsp;&nbsp;Ak\u00e9ko\u013evek ilustr\u00e1cie, popisn\u00e9 materi\u00e1ly alebo reklama, ktor\u00fa vyd\u00e1vame, alebo ak\u00e9ko\u013evek popisy a\/alebo grafiky obsiahnut\u00e9 v propaga\u010dn\u00fdch materi\u00e1loch alebo uverejnen\u00e9 na Internetovej str\u00e1nke sa vyd\u00e1vaj\u00fa alebo uverej\u0148uj\u00fa v\u00fdlu\u010dne s cie\u013eom poskytn\u00fa\u0165 pribli\u017en\u00fa predstavu o slu\u017eb\u00e1ch a dielach, ktor\u00e9 s\u00fa v nich op\u00edsan\u00e9; a&nbsp;tieto netvoria s\u00fa\u010das\u0165 OP ani zmluvn\u00e9ho vz\u0165ahu.<\/p>\n\n\n\n<p><strong>\u010cl\u00e1nok II.<\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>ROZSAH DIELA A POSKYTOVAN\u00ddCH SLU\u017dIEB<\/strong><strong><\/strong><\/p>\n\n\n\n<p>2.1.&nbsp;&nbsp;Rozsah vypracovania pr\u00edslu\u0161n\u00e9ho druhu diela pod\u013ea Objedn\u00e1vky zah\u0155\u0148a (ak Objedn\u00e1vka alebo osobitn\u00e1, aj dodato\u010dn\u00e1 dohoda neustanovuje inak):<\/p>\n\n\n\n<p>2.2.&nbsp;&nbsp;\u0160t\u00fadia interi\u00e9ru:&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>a)&nbsp;&nbsp;konzult\u00e1cie Zhotovite\u013ea k 2D a 3D n\u00e1vrhu v trvan\u00ed maxim\u00e1lne 120 min<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;vyhotovenie zadania \u2013 spracovanie po\u017eiadaviek Objedn\u00e1vate\u013ea ako podklad k&nbsp;vypracovaniu \u0161t\u00fadie interi\u00e9ru<\/p>\n\n\n\n<p>c)&nbsp;&nbsp;&nbsp;2D n\u00e1vrh dispozi\u010dn\u00e9ho rie\u0161enia priestoru (vr. pr\u00edpadn\u00fdch zmien\/\u00faprav\/roz\u0161\u00edrenia\/z\u00fa\u017eenia na po\u017eiadanie Objedn\u00e1vate\u013ea v rozsahu najviac 2x nov\u00fdch variant 2D n\u00e1vrhu),<\/p>\n\n\n\n<p>d)&nbsp;&nbsp;vyhotovenie tzv. \u201eMood&nbsp;boardu\u201c interi\u00e9ru, ktor\u00fd spo\u010d\u00edva najm\u00e4 v&nbsp;n\u00e1vrhu farebnosti, \u0161t\u00fdlu interi\u00e9ru a&nbsp;zaria\u010fovac\u00edch prvkov (vr. pr\u00edpadn\u00fdch zmien\/\u00faprav\/roz\u0161\u00edrenia\/z\u00fa\u017eenia na po\u017eiadanie Objedn\u00e1vate\u013ea v rozsahu najviac 2x nov\u00fdch variant&nbsp;Mood&nbsp;boardu),<\/p>\n\n\n\n<p>e)&nbsp;&nbsp;3D n\u00e1vrh vizualiz\u00e1cie grafick\u00e9ho stv\u00e1rnenia navrhovan\u00e9ho priestoru (zapracovanie zmien do vyhotoven\u00e9ho 3D n\u00e1vrhu v maxim\u00e1lne dvoch krokoch. Jedn\u00fdm krokom sa rozumie celkov\u00e9 spracovanie po\u017eiadaviek klienta k posledn\u00e9mu vyhotoveniu 3D n\u00e1vrhu, vypracovanie jednej novej varianty 3D n\u00e1vrhu, v pr\u00edpade po\u017eiadavky Objedn\u00e1vate\u013ea na zmenu 3D n\u00e1vrhu. Pre \u00fa\u010dely tejto Zmluvy sa za nov\u00fa variantu 3D n\u00e1vrhu pova\u017euje zmena dispoz\u00edcie alebo \u0161t\u00fdlu interi\u00e9ru Priestoru, zmena farieb a materi\u00e1lu nie je pova\u017eovan\u00e1 za zmenu 3D n\u00e1vrhu), a\/alebo pr\u00edpadn\u00e1<\/p>\n\n\n\n<p>2.3.&nbsp;&nbsp;Architektonick\u00e1 \u0161t\u00fadia a&nbsp;projekt na stavebn\u00e9 povolenie:<\/p>\n\n\n\n<p>a)&nbsp;&nbsp;konzult\u00e1cie Zhotovite\u013ea k \u0161t\u00fadii v trvan\u00ed maxim\u00e1lne 120 min.<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;vyhotovenie zadania \u2013 spracovanie po\u017eiadaviek Objedn\u00e1vate\u013ea ako podklad k vypracovaniu \u0161t\u00fadie interi\u00e9ru<\/p>\n\n\n\n<p>c)&nbsp;&nbsp;&nbsp;koncept \u2013 dispoz\u00edcia a rie\u0161enie pozemku (vjazd, vstup, v\u00fdstupy na terasu, dvor, baz\u00e9n)<\/p>\n\n\n\n<p>d)&nbsp;&nbsp;funk\u010dn\u00e9 rie\u0161enie situ\u00e1cie<\/p>\n\n\n\n<p>e)&nbsp;&nbsp;n\u00e1vrh dispozi\u010dn\u00e9ho rie\u0161enia<\/p>\n\n\n\n<p>f)&nbsp;&nbsp;&nbsp;celkov\u00e9 stv\u00e1rnenie domu \u2013&nbsp;hmotov\u00fd&nbsp;a materi\u00e1lov\u00fd n\u00e1vrh<\/p>\n\n\n\n<p>g)&nbsp;&nbsp;bal\u00edk zah\u0155\u0148a zapracovanie zmien v&nbsp;maxim\u00e1lne 3-troch krokoch<\/p>\n\n\n\n<p>2.4.&nbsp;&nbsp;Dom\u00e1ca n\u00e1v\u0161teva a \u010fal\u0161ie slu\u017eby:<\/p>\n\n\n\n<p>a)&nbsp;&nbsp;&nbsp;Na podklade potreby a predch\u00e1dzaj\u00facej dohody medzi Zhotovite\u013eom a&nbsp;Objedn\u00e1vate\u013eom m\u00f4\u017ee by\u0165 uskuto\u010dnen\u00e1 obhliadka na mieste.<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;Zhotovite\u013e si vyhradzuje pr\u00e1vo rozhodn\u00fa\u0165 o&nbsp;uskuto\u010dnen\u00ed obhliadky na mieste, t. j. Objedn\u00e1vate\u013eovi na tak\u00fato slu\u017ebu nevznik\u00e1 n\u00e1rok, ak to nevypl\u00fdva z&nbsp;potvrdenej Objedn\u00e1vky.<\/p>\n\n\n\n<p>c)&nbsp;&nbsp;&nbsp;Pr\u00edpadn\u00e9 zameranie navrhovan\u00e9ho priestoru bude realizovan\u00e9 sp\u00f4sobom umo\u017e\u0148uj\u00facim vytvorenie \u0161t\u00fadie interi\u00e9ru<\/p>\n\n\n\n<p>2.5.&nbsp;&nbsp;Objedn\u00e1vate\u013e zodpoved\u00e1 za spr\u00e1vnos\u0165 a&nbsp;\u00faplnos\u0165 poskytnut\u00fdch osobn\u00fdch a&nbsp;in\u00fdch \u00fadajov, ako aj poskytnut\u00fdch podkladov.<\/p>\n\n\n\n<p>2.6.&nbsp;&nbsp;V&nbsp;pr\u00edpade, ak Objedn\u00e1vate\u013e nedisponuje potrebn\u00fdmi podkladmi pre \u00fa\u010dely zhotovenia Diela, po vz\u00e1jomnej dohode m\u00f4\u017eu by\u0165 tieto zabezpe\u010den\u00e9 zo strany Zhotovite\u013ea v&nbsp;s\u00fa\u010dinnosti s&nbsp;tret\u00edmi stranami, ako napr\u00edklad spolupracuj\u00faci geodet, znalec a&nbsp;pod. T\u00fato skuto\u010dnos\u0165 si Objedn\u00e1vate\u013e a&nbsp;Zhotovite\u013e potvrdia v&nbsp;p\u00edsomnej forme.<\/p>\n\n\n\n<p>2.7.&nbsp;&nbsp;Vytv\u00e1ran\u00fd virtu\u00e1lny n\u00e1vrh v&nbsp;digit\u00e1lnej podobe je ur\u010den\u00fd na ilustra\u010dn\u00e9 \u00fa\u010dely a nie je ur\u010den\u00fd na poskytnutie presnej \u0161pecifik\u00e1cie projektu ani na zaru\u010denie konkr\u00e9tnych v\u00fdsledkov.<\/p>\n\n\n\n<p>2.8.&nbsp;&nbsp;Vo virtu\u00e1lnych n\u00e1vrhoch m\u00f4\u017eu by\u0165 umiestnen\u00e9 produkty a slu\u017eby tret\u00edch subjektov, a&nbsp;ich zapracovanie m\u00e1 \u010disto charakter odpor\u00fa\u010dania. Zhotovite\u013e nenesie \u017eiadnu zodpovednos\u0165 za pr\u00edpadn\u00fa nedostupnos\u0165 objektov pou\u017eit\u00fdch vo virtu\u00e1lnom n\u00e1vrhu, ak\u00fdko\u013evek nespr\u00e1vny n\u00e1bytok objednan\u00fd Objedn\u00e1vate\u013eom alebo tre\u0165ou stranou na strane Objedn\u00e1vate\u013ea alebo za n\u00e1bytok, ktor\u00fd m\u00f4\u017ee ma\u0165 nespr\u00e1vnu ve\u013ekos\u0165, nespr\u00e1vnu farbu a&nbsp;podobne.<\/p>\n\n\n\n<p>2.9.&nbsp;&nbsp;Zhotovite\u013e si vyhradzuje pr\u00e1vo odmietnu\u0165 po\u017eiadavku o&nbsp;roz\u0161\u00edrenie predmetu zhotovenia Diela a\/alebo dodato\u010dne vy\u017eiadan\u00fdch slu\u017eieb, a to na podklade jeho zv\u00e1\u017eenia kapacitn\u00fdch a&nbsp;in\u00fdch mo\u017enost\u00ed.<\/p>\n\n\n\n<p><strong>\u010cl\u00e1nok III.<\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>PR\u00c1VA DU\u0160EVN\u00c9HO VLASTN\u00cdCTVA<\/strong><strong><\/strong><\/p>\n\n\n\n<p>5.1.&nbsp;&nbsp;Objedn\u00e1vate\u013e berie na vedomie, \u017ee v s\u00favislosti so zhotoven\u00edm Diela a&nbsp;Dielom samotn\u00fdm, ako aj ak\u00fdmiko\u013evek k&nbsp;nemu prisl\u00fachaj\u00facimi pr\u00e1vami du\u0161evn\u00e9ho vlastn\u00edctva je pou\u017eitie tak\u00fdchto pr\u00e1v du\u0161evn\u00e9ho vlastn\u00edctva Objedn\u00e1vate\u013eom podmienen\u00e9 z\u00edskan\u00edm p\u00edsomnej licencie zo strany Zhotovite\u013ea, spravidla v&nbsp;podobe objedn\u00e1vky za s\u00fa\u010dasn\u00e9ho splnenia podmienky, \u00fahrady Ceny za Dielo v&nbsp;plnej v\u00fd\u0161ke.<\/p>\n\n\n\n<p>5.2.&nbsp;&nbsp;S\u00fa\u010dasne Objedn\u00e1vate\u013e berie na vedomie, a&nbsp;zav\u00e4zuje sa, \u017ee \u017eiadne \u00fadaje, inform\u00e1cie, obr\u00e1zky alebo in\u00fd obsah, ktor\u00fd poskytne Zhotovite\u013eovi, neporu\u0161uj\u00fa pr\u00e1va du\u0161evn\u00e9ho vlastn\u00edctva \u017eiadnej tretej strany ani inak nie s\u00fa v nes\u00falade so v\u0161etk\u00fdmi platn\u00fdmi z\u00e1konmi a predpismi. Objedn\u00e1vate\u013e sa zav\u00e4zuje od\u0161kodni\u0165 Zhotovite\u013ea za v\u0161etky z\u00e1v\u00e4zky, n\u00e1klady, v\u00fddavky, \u0161kody a straty (vr\u00e1tane ak\u00fdchko\u013evek priamych, nepriamych alebo n\u00e1sledn\u00fdch str\u00e1t, u\u0161l\u00e9ho zisku, straty dobr\u00e9ho mena a v\u0161etk\u00fdch \u00farokov, pok\u00fat a pr\u00e1vnych a in\u00fdch odborn\u00fdch n\u00e1kladov a v\u00fddavkov), ktor\u00e9 Zhotovite\u013e utrp\u00ed alebo mu vznikn\u00fa v d\u00f4sledku ak\u00e9hoko\u013evek poru\u0161enia povinnosti pod\u013ea tohto bodu zo strany Objedn\u00e1vate\u013ea alebo v s\u00favislosti s n\u00edm.<\/p>\n\n\n\n<p><strong>\u010cl\u00e1nok IV.<\/strong><\/p>\n\n\n\n<p><strong>OBJEDN\u00c1VKA A&nbsp;ZHOTOVENIE DIELA<\/strong><strong><\/strong><\/p>\n\n\n\n<p>4.1.&nbsp;&nbsp;Z\u00c1V\u00c4ZN\u00c1 OBJEDN\u00c1VKA<\/p>\n\n\n\n<p>4.1.1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Fyzick\u00e1 alebo pr\u00e1vnick\u00e1 osoba ako Objedn\u00e1vate\u013e, ktor\u00e1 prejav\u00ed z\u00e1ujem o zhotovenie diela Zhotovite\u013eom (Dielom sa rozumie architektonick\u00fd n\u00e1vrh interi\u00e9ru, vr. zariadenia \u201einteri\u00e9r\u201c; a\/alebo architekt\u00fara pre \u00fa\u010dely v\u00fdstavby\/rekon\u0161trukcie domu \u201earchitekt\u00fara\u201c, najm\u00e4 pod\u013ea \u010dl\u00e1nku II. OP), je telefonicky alebo p\u00edsomne, pr\u00edpadne osobne kontaktovan\u00e1 zo strany zodpovednej osoby Zhotovite\u013ea za \u00fa\u010delom obdr\u017eania potrebn\u00fdch inform\u00e1ci\u00ed pre \u00fa\u010dely spracovania n\u00e1vrhu objedn\u00e1vkov\u00e9ho formul\u00e1ra, ktor\u00e9ho s\u00fa\u010das\u0165ou je tie\u017e n\u00e1vrh cenovej ponuky Diela.<\/p>\n\n\n\n<p>4.1.2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Na podklade zadania objedn\u00e1vate\u013ea a&nbsp;postupu pod\u013ea bodu 4.1.1. Zhotovite\u013e vypracuje n\u00e1vrh z\u00e1v\u00e4znej objedn\u00e1vky (pozn. za Objedn\u00e1vku sa pova\u017euje aj cenov\u00e1 ponuka vypracovan\u00e1 Zhotovite\u013eom), ktorej obsahom je najm\u00e4: \u00fadaje Zhotovite\u013ea, identifika\u010dn\u00e9 \u00fadaje objedn\u00e1vate\u013ea, predmet zhotovenia diela v&nbsp;rozsahu zadefinovania a&nbsp;bli\u017e\u0161ej \u0161pecifik\u00e1cie nehnute\u013enosti, ur\u010denia rozsahu a&nbsp;sp\u00f4sobu zhotovenia diela, doby dodania, jednotkov\u00e1\/v\u00fdsledn\u00e1 cena \u010dasti\/cel\u00e9ho diela (Cena za Dielo), pr\u00edpadn\u00e9 osobitn\u00e9 podmienky. Pr\u00edpadn\u00e9 pr\u00edlohy objedn\u00e1vky bud\u00fa tvori\u0165 s\u00fa\u010das\u0165 e-mailu.<\/p>\n\n\n\n<p>4.1.3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;V&nbsp;pr\u00edpade s\u00fahlasu Objedn\u00e1vate\u013ea s podmienkami stanoven\u00fdmi Zhotovite\u013eom m\u00e1 Objedn\u00e1vate\u013e mo\u017enos\u0165 z\u00e1v\u00e4zne potvrdi\u0165 objedn\u00e1vku, t. j. prejavi\u0165 z\u00e1ujem o&nbsp;zhotovenie diela formou odoslania potvrdzuj\u00faceho e-mailu na adresu Zhotovite\u013ea, z&nbsp;ktorej Zhotovite\u013e zaslal ponuku na Objedn\u00e1vate\u013ea pr\u00edpadne na v\u0161eobecn\u00fa e-mailov\u00fa adresu uveden\u00fa v&nbsp;kontaktn\u00fdch \u00fadajov Zhotovite\u013ea (<a href=\"http:\/\/www.livingclub.eu\/kontakt\">www.livingclub.eu\/kontakt<\/a>), na podklade \u010doho Zhotovite\u013e vystav\u00ed Objedn\u00e1vate\u013eovi fakt\u00faru, da\u0148ov\u00fd doklad na prv\u00fa \u010das\u0165 Ceny za Dielo pod\u013ea bodu 4.2.1 p\u00edsm. a) t\u00fdchto OP.<\/p>\n\n\n\n<p>4.1.4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\u00dahradou prvej \u010dasti Ceny za Dielo Objedn\u00e1vate\u013eom sa objedn\u00e1vka pova\u017euje za potvrden\u00fa, z\u00e1v\u00e4zn\u00fa a&nbsp;nemenn\u00fa, na podklade \u010doho vznik\u00e1 medzi Zhotovite\u013eom a&nbsp;Objedn\u00e1vate\u013eom zmluvn\u00fd vz\u0165ah, ak sa Zhotovite\u013e a&nbsp;objedn\u00e1vate\u013e nedohodne p\u00edsomne inak. \u00dahradou prvej \u010dasti Ceny za Dielo z\u00e1rove\u0148 Objedn\u00e1vate\u013e bezpodmiene\u010dne vyjadruje s\u00fahlas s podmienkami uveden\u00fdmi v Objedn\u00e1vke a vo OP. Uzatvoren\u00e1 zmluva sa spravuje ustanoveniami upravuj\u00facimi&nbsp;nomin\u00e1tny&nbsp;zmluvn\u00fd typ, zmluvu o&nbsp;dielo.<\/p>\n\n\n\n<p>4.1.5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Vzh\u013eadom na skuto\u010dnos\u0165, \u017ee predmetom objedn\u00e1vky je zhotovenie diela na z\u00e1kazku, od zmluvy nie je mo\u017en\u00e9 odst\u00fapi\u0165 v lehote 14 dn\u00ed pod\u013ea&nbsp;ust. \u00a7 7 ods. 6 Z\u00e1kona \u010d. 102\/2014 Z. z.<\/p>\n\n\n\n<p>4.2.&nbsp;&nbsp;\u00daHRADA CENY DIELA<\/p>\n\n\n\n<p>4.2.1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Cenu za Dielo sa Objedn\u00e1vate\u013e zav\u00e4zuje na podklade z\u00e1v\u00e4zn\u00e9ho potvrdenia objedn\u00e1vky zaplati\u0165 nasledovne:<\/p>\n\n\n\n<p>a)&nbsp;&nbsp;&nbsp;prv\u00fa \u010das\u0165 Ceny za Dielo vo v\u00fd\u0161ke 50% z&nbsp;celkovej Ceny za Diela sa Objedn\u00e1vate\u013e zav\u00e4zuje pouk\u00e1za\u0165 v&nbsp;prospech bankov\u00e9ho \u00fa\u010dtu Zhotovite\u013ea a&nbsp;v&nbsp;dobe splatnosti uvedenom na doru\u010denej fakt\u00fare pod\u013ea bodu 4.1.3 OP,<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;druh\u00e1 \u010das\u0165 Ceny za Dielo vo v\u00fd\u0161ke 50% z&nbsp;celkovej Ceny za Diela je splatn\u00e1 v de\u0148 dodania zhotoven\u00e9ho Diela \u2013 prvej verzie pod\u013ea bodu 4.3.4 v&nbsp;spojen\u00ed s&nbsp;bodom 4.3.8 \u010dl\u00e1nku IV. OP, ak OP alebo Objedn\u00e1vka neustanovuj\u00fa inak v&nbsp;prospech bankov\u00e9ho \u00fa\u010dtu Zhotovite\u013ea uvedenom na doru\u010denej fakt\u00fare.<\/p>\n\n\n\n<p>4.2.2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Zhotovite\u013e nezodpoved\u00e1 za vady a nedostatky, ktor\u00e9 boli sp\u00f4soben\u00e9 pou\u017eit\u00edm podkladov poskytnut\u00fdch Objedn\u00e1vate\u013eom a pri ktor\u00fdch Zhotovite\u013e ani pri vynalo\u017een\u00ed v\u0161etkej odbornej starostlivosti nemohol zisti\u0165 ich nevhodnos\u0165, pr\u00edpadne na \u0148u upozornil Objedn\u00e1vate\u013ea a ten na ich pou\u017eit\u00ed trval.<\/p>\n\n\n\n<p>4.2.3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vka (zmluva) sa st\u00e1va z\u00e1v\u00e4znou a platnou \u00fahradou prvej \u010dasti Ceny za Dielo.<\/p>\n\n\n\n<p>4.2.4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Zaplaten\u00e1 prv\u00e1 \u010das\u0165 Ceny za Dielo je nevratn\u00e1.<\/p>\n\n\n\n<p>4.2.5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e potvrden\u00edm objedn\u00e1vky s\u00fahlas\u00ed so zaslan\u00edm elektronickej fakt\u00fary pod\u013ea&nbsp;ust. \u00a7 71 ods. 1 p\u00edsm. b) z\u00e1kona 222\/2004 Z. z. o&nbsp;dani z&nbsp;pridanej hodnoty prostredn\u00edctvom elektronickej po\u0161ty na e-mailov\u00fa adresu uveden\u00fa v objedn\u00e1vke. Elektronick\u00e1 fakt\u00fara je riadnym da\u0148ov\u00fdm dokladom v zmysle platn\u00fdch pr\u00e1vnych predpisov.<\/p>\n\n\n\n<p>4.3.&nbsp;&nbsp;SP\u00d4SOB SPRACOVANIA DIELA A&nbsp;DODACIA DOBA<\/p>\n\n\n\n<p>4.3.1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Na z\u00e1klade \u00fahrady prvej \u010dasti Ceny za Dielo nadvia\u017ee Zhotovite\u013e s&nbsp;Objedn\u00e1vate\u013eom kontakt formou online video-hovoru, alt. telefonick\u00fd kontakt, v&nbsp;r\u00e1mci ktor\u00e9ho Objedn\u00e1vate\u013e odprezentuje Zhotovite\u013eovi svoju predstavu na realiz\u00e1ciu Diela, zad\u00e1 z\u00e1v\u00e4zn\u00e9 po\u017eiadavky na vypracovanie Diela, ktor\u00e9 bud\u00fa Zhotovite\u013eom ako sum\u00e1r zadania sp\u00edsan\u00e9 a&nbsp;odoslan\u00e9 Objedn\u00e1vate\u013eovi p\u00edsomne (e-mailom) na ods\u00fahlasenie. Objedn\u00e1vate\u013e zodpoved\u00e1 za dostato\u010dn\u00e9, v\u010dasn\u00e9, presn\u00e9 a&nbsp;\u00fapln\u00e9 poskytnutie inform\u00e1ci\u00ed Zhotovite\u013eovi. Zhotovite\u013e si vyhradzuje pr\u00e1vo za\u010da\u0165 so zhotovovan\u00edm Diela na podklade obdr\u017eania po\u017eadovan\u00fdch podkladov zo strany Objedn\u00e1vate\u013ea (napr. detailn\u00e9 zameranie; pri novom RD geodetick\u00e9 zameranie pozemku a v\u00fd\u0161kopis ter\u00e9nu; rekon\u0161trukcii RD &#8211; zameranie domu; statika, projekt&nbsp;svetlotechniky&nbsp;a&nbsp;podobne).<\/p>\n\n\n\n<p>4.3.2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;V&nbsp;pr\u00edpade, ak to situ\u00e1cia alebo objedn\u00e1vate\u013e vy\u017eaduje, zabezpe\u010d\u00ed Zhotovite\u013e na podklade osobitnej spravidla p\u00edsomnej dohody (minim\u00e1lne v&nbsp;rozsahu predmet, miesto a term\u00edn obhliadky, odplata a&nbsp;n\u00e1hrada cestovn\u00fdch v\u00fddavkov) osobn\u00fa obhliadku priestoru na mieste samom, vo vz\u0165ahu ku ktor\u00e9mu\/v r\u00e1mci ktor\u00e9ho sa bude Dielo zhotovova\u0165 (zameranie, zadokumentovanie a&nbsp;podobne).<\/p>\n\n\n\n<p>4.3.3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Po vyjadren\u00ed s\u00fahlasu Objedn\u00e1vate\u013ea so zadan\u00edm na podklade postupu pod\u013ea bodu 4.3.1. (pr\u00edpadne 4.3.2.) Zhotovite\u013e zapo\u010dne proces zhotovovania Diela. Ods\u00fahlasenie zadania sa pova\u017euje za v\u00fdchodz\u00ed \u010dasov\u00fd ukazovate\u013e pri v\u00fdpo\u010dte doby na zhotovenie Diela.<\/p>\n\n\n\n<p>4.3.4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\u0160tandardn\u00e1 doba na zhotovenie (vypracovanie prvej verzie Diela, t. j. prv\u00e9ho n\u00e1vrhu je 45 kalend\u00e1rnych dn\u00ed, ak z\u00e1v\u00e4zn\u00e1 objedn\u00e1vka alebo osobitn\u00e1 p\u00edsomn\u00e1 dohoda Zhotovite\u013ea a&nbsp;Objedn\u00e1vate\u013ea neustanovuje inak. T\u00fdm nie je dotknut\u00fd postup pod\u013ea bodu 4.3.6. a&nbsp;4.3.7. OP.<\/p>\n\n\n\n<p>4.3.5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e s\u00fahlas\u00ed a&nbsp;nenamieta, aby bolo Dielo zhotovovan\u00e9\/zhotoven\u00e9 prostredn\u00edctvom tretej osoby, subdod\u00e1vate\u013eom na strane Zhotovite\u013ea. V&nbsp;takom pr\u00edpade Zhotovite\u013e zodpoved\u00e1 tak, ako by Dielo zhotovoval s\u00e1m. Zhotovite\u013e je na zhotovenie Diela opr\u00e1vnen\u00fd vyu\u017e\u00edva\u0165 len odborne sp\u00f4sobil\u00e9 osoby.<\/p>\n\n\n\n<p>4.3.6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e sa zav\u00e4zuje poskytn\u00fa\u0165 Zhotovite\u013eovi na po\u017eiadanie s\u00fa\u010dinnos\u0165 pri zhotovovan\u00ed Diela do 5 dn\u00ed odo d\u0148a p\u00edsomnej alebo telefonickej v\u00fdzvy. Doba dodania sa automaticky predl\u017euje o \u010das &#8211; od momentu zadania po\u017eiadavky Zhotovite\u013eom o poskytnutie s\u00fa\u010dinnosti zo strany Objedn\u00e1vate\u013ea do jej riadneho poskytnutia Objedn\u00e1vate\u013eom, a tie\u017e o \u010das objekt\u00edvnej nemo\u017enosti zhotovova\u0165 Dielo zo strany Zhotovite\u013ea z d\u00f4vodov tzv. vy\u0161\u0161ej moci. V pr\u00edpade, \u017ee sa Objedn\u00e1vate\u013e nevyjadr\u00ed k predlo\u017een\u00fdm n\u00e1vrhom (vypracovan\u00fdm na podklade zadania a&nbsp;za n\u00e1vrhy ozna\u010den\u00e9 Zhotovite\u013eom) do 30 dn\u00ed, Dielo sa pova\u017euje za riadne a v\u010das zhotoven\u00e9 a&nbsp;odovzdan\u00e9 bez n\u00e1roku Objedn\u00e1vate\u013ea na \u010fal\u0161ie \u00fapravy a\/alebo zmeny a\/alebo doplnenia, ak sa Objedn\u00e1vate\u013e a&nbsp;Zhotovite\u013e nedohodn\u00fa p\u00edsomne inak.<\/p>\n\n\n\n<p>4.3.7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Ak Zhotovite\u013e nespln\u00ed svoj z\u00e1v\u00e4zok vypracova\u0165 a odovzda\u0165 Dielo (v rozsahu tzv. prvej verzie) v&nbsp;dohodnutom term\u00edne (\u0161tandardne 45 kalend\u00e1rnych dn\u00ed) a z\u00e1rove\u0148 neodovzd\u00e1 Dielo ani v dodato\u010dnej lehote 25 pracovn\u00fdch dn\u00ed, Objedn\u00e1vate\u013e m\u00e1 pr\u00e1vo na z\u013eavu z&nbsp;Ceny za Dielo, a&nbsp;to vo v\u00fd\u0161ke 10%. V&nbsp;pr\u00edpade, ak Dielo nebude zhotoven\u00e9 a&nbsp;odovzdan\u00e9 ani do 60 dn\u00ed odo d\u0148a vzniku ome\u0161kania so zhotoven\u00edm Diela, Objedn\u00e1vate\u013e je opr\u00e1vnen\u00fd od zmluvy o&nbsp;dielo odst\u00fapi\u0165.<\/p>\n\n\n\n<p>4.3.8.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Z\u00e1kladn\u00fd rozsah Diela je ur\u010den\u00fd pod\u013ea Objedn\u00e1vky a&nbsp;v&nbsp;s\u00falade s&nbsp;\u010dl\u00e1nkom II. OP.<\/p>\n\n\n\n<p>4.4.&nbsp;&nbsp;ODOVZDANIE DIELA<\/p>\n\n\n\n<p>4.4.1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Zhotovite\u013e za\u0161le Objedn\u00e1vate\u013eovi zhotoven\u00e9 Dielo na e-mailov\u00fa adresu Objedn\u00e1vate\u013ea v&nbsp;dohodnutom term\u00edne, s\u00fa\u010dasne v&nbsp;zmysle a&nbsp;za podmienok pod\u013ea OP.<\/p>\n\n\n\n<p>4.4.2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Pr\u00edpadn\u00e9 \u00fapravy, zmeny, roz\u0161\u00edrenia, z\u00fa\u017eenia, pr\u00edpadne zapracovanie zmien v&nbsp;\u010fal\u0161\u00edch krokoch bud\u00fa Zhotovite\u013eom a&nbsp;Objedn\u00e1vate\u013eom komunikovan\u00e9, pri\u010dom sp\u00f4sob a&nbsp;doba dodato\u010dn\u00fdch \u00faprav bude predmetom zapracovania na podklade osobitnej dohody, ktor\u00e1 bude p\u00edsomne potvrden\u00e1.<\/p>\n\n\n\n<p>4.4.3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e m\u00e1 po dohode so Zhotovite\u013eom mo\u017enos\u0165 roz\u0161\u00edrenia p\u00f4vodnej objedn\u00e1vky o&nbsp;nasledovn\u00e9 doplnkov\u00e9 slu\u017eby\/v\u00fdstupy:<\/p>\n\n\n\n<p><strong>INTERI\u00c9R:<\/strong><strong><\/strong><\/p>\n\n\n\n<p>a)&nbsp;&nbsp;&nbsp;v\u00fdpis zaria\u010fovac\u00edch prvkov a&nbsp;materi\u00e1lov<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;v\u00fdkaz v\u00fdmer a pl\u00f4ch<\/p>\n\n\n\n<p>c)&nbsp;&nbsp;&nbsp;2D n\u00e1kres kuchyne<\/p>\n\n\n\n<p>d)&nbsp;&nbsp;pl\u00e1n kladenia obkladov a&nbsp;dla\u017eieb<\/p>\n\n\n\n<p>e)&nbsp;&nbsp;&nbsp;dokument\u00e1ciu pre b\u00faracie a stavebn\u00e9 pr\u00e1ce<\/p>\n\n\n\n<p>f)&nbsp;&nbsp;&nbsp;&nbsp;povrchov\u00e9 \u00fapravy stien<\/p>\n\n\n\n<p>g)&nbsp;&nbsp;&nbsp;pl\u00e1n kladenia podl\u00e1h<\/p>\n\n\n\n<p>h)&nbsp;&nbsp;pl\u00e1n rozmiestnenia a ot\u00e1\u010dania dver\u00ed<\/p>\n\n\n\n<p>i)&nbsp;&nbsp;&nbsp;&nbsp;dokument\u00e1ciu k elektroin\u0161tal\u00e1cii, vodoin\u0161tal\u00e1cii, vzduchotechnike, k\u00fareniu a&nbsp;chladeniu<\/p>\n\n\n\n<p><strong>j)&nbsp;&nbsp;&nbsp;<\/strong>v\u00fdkresov\u00e1 dokument\u00e1cia pre v\u00fdrobu n\u00e1bytku<strong><\/strong><\/p>\n\n\n\n<p><strong>ARCHITEKT\u00daRA:<\/strong><strong><\/strong><\/p>\n\n\n\n<p>k)&nbsp;&nbsp;rozpracovanie architektonickej \u0161t\u00fadie do potrebnej podrobnosti na stavebn\u00e9 povolenie<\/p>\n\n\n\n<p>l)&nbsp;&nbsp;&nbsp;&nbsp;dokument\u00e1cia na realiz\u00e1ciu stavby \u2013 roz\u0161\u00edrenie dokument\u00e1cie do miery pre realiz\u00e1ciu stavby, detaily,&nbsp;v\u00fdkazy&nbsp;kon\u0161trukci\u00ed a&nbsp;pod.<\/p>\n\n\n\n<p>m)&nbsp;&nbsp;projekt z\u00e1hrady \u2013 exteri\u00e9ru stavby zahr\u0148uj\u00faci situ\u00e1ciu, sadov\u00e9 \u00fapravy, technick\u00e9 prvky, v\u00fdkazy<\/p>\n\n\n\n<p>4.4.4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Fin\u00e1lnym ods\u00fahlasen\u00edm Diela Objedn\u00e1vate\u013eom, alebo za splnenia podmienok pod\u013ea bodu 4.3.6 sa Dielo pova\u017euje za riadne odovzdan\u00e9.<\/p>\n\n\n\n<p>4.5.&nbsp;&nbsp;OSOBITN\u00c9 USTANOVENIA<\/p>\n\n\n\n<p>4.5.1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e z\u00e1v\u00e4zn\u00fdm potvrden\u00edm Objedn\u00e1vky ude\u013euje Zhotovite\u013eovi s\u00fahlas na pou\u017eitie grafick\u00fdch zobrazen\u00ed Diela na prezenta\u010dn\u00e9 a propaga\u010dn\u00e9 \u00fa\u010dely.<\/p>\n\n\n\n<p>4.5.2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Ustanovenia objedn\u00e1vky maj\u00fa prednos\u0165 pred ustanoveniami t\u00fdchto OP, ak nie je ustanoven\u00e9 inak.<\/p>\n\n\n\n<p>4.5.3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e je opr\u00e1vnen\u00fd u&nbsp;Zhotovite\u013ea uplatni\u0165 n\u00e1rok zo zodpovednosti za vady, a&nbsp;to bezodkladne po tom, ako mal mo\u017enos\u0165 sa o&nbsp;existencii v\u00e1d dozvedie\u0165. Pr\u00edpadn\u00e9 reklam\u00e1cie bud\u00fa predmetom reklama\u010dn\u00e9ho konania pod\u013ea t\u00fdchto OP.<\/p>\n\n\n\n<p>4.5.4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Zhotovite\u013e m\u00e1 pr\u00e1vo a\u017e do momentu odoslania predmetu Diela od zmluvy odst\u00fapi\u0165, a to z ak\u00e9hoko\u013evek d\u00f4vodu alebo bez uvedenia d\u00f4vodu.<\/p>\n\n\n\n<p><strong>\u010cl\u00e1nok V.<\/strong><\/p>\n\n\n\n<p><strong>Z\u00e1ru\u010dn\u00e1 doba a&nbsp;reklama\u010dn\u00fd poriadok, vyl\u00fa\u010denie zodpovednosti<\/strong><\/p>\n\n\n\n<p>5.1.&nbsp;&nbsp;Zhotovite\u013e na Dielo poskytuje \u0161tandardn\u00fa (minim\u00e1lnu) z\u00e1ruku pod\u013ea platn\u00fdch pr\u00e1vnych predpisov.<\/p>\n\n\n\n<p>5.2.&nbsp;&nbsp;Na uplatnenie reklam\u00e1cie Diela sa vy\u017eaduje prilo\u017eenie objedn\u00e1vky a&nbsp;potvrdenia o&nbsp;zaplaten\u00ed celej Ceny za Dielo. Pokia\u013e ned\u00f4jde k zaplateniu Ceny za Dielo, Zhotovite\u013e m\u00e1 pr\u00e1vo odmietnu\u0165 reklam\u00e1ciu ako neod\u00f4vodnen\u00fa.<\/p>\n\n\n\n<p>5.3.&nbsp;&nbsp;Ak m\u00e1 Dielo vadu, ktor\u00fa mo\u017eno odstr\u00e1ni\u0165, m\u00e1 Objedn\u00e1vate\u013e pr\u00e1vo, aby bola bezplatne, v\u010das a riadne odstr\u00e1nen\u00e1. Lehotu n\u00e1pravy ur\u010d\u00ed Zhotovite\u013e, nebude v\u0161ak dlh\u0161ia ako 30 kalend\u00e1rnych dn\u00ed. Ak ide o in\u00e9 neodstr\u00e1nite\u013en\u00e9 vady, m\u00e1 objedn\u00e1vate\u013e pr\u00e1vo na primeran\u00fa z\u013eavu z&nbsp;Ceny za Dielo.<\/p>\n\n\n\n<p>5.4.&nbsp;&nbsp;Vybaven\u00edm reklam\u00e1cie sa rozumie ukon\u010denie reklama\u010dn\u00e9ho konania odovzdan\u00edm opraven\u00e9ho Diela, vyplatenie primeranej z\u013eavy z&nbsp;Ceny za Dielo, alebo jej od\u00f4vodnen\u00e9 zamietnutie.<\/p>\n\n\n\n<p>5.5.&nbsp;&nbsp;Objedn\u00e1vate\u013e potvrden\u00edm z\u00e1v\u00e4znej objedn\u00e1vky vyjadruje uzrozumenie a&nbsp;s\u00fahlas s&nbsp;t\u00fdm, \u017ee Dielo (n\u00e1vrh) ako virtu\u00e1lny n\u00e1vrh interi\u00e9ru nie \u0161tandardn\u00e1 slu\u017eba interi\u00e9rov\u00e9ho dizajnu (zariadenie v&nbsp;r\u00e1mci konkr\u00e9tnych technick\u00fdch, fyzik\u00e1lnych a&nbsp;in\u00fdch podmienok priestoru) a&nbsp;rovnako konzult\u00e1cia o&nbsp;predstav\u00e1ch Objedn\u00e1vate\u013ea a&nbsp;jeho konkr\u00e9tnych potreb\u00e1ch v oblasti dizajnu sa nepova\u017euje za radu, v&nbsp;oboch pr\u00edpadoch ide o&nbsp;odpor\u00fa\u010danie, nez\u00e1v\u00e4zn\u00fd vizu\u00e1l, usmernenie alebo&nbsp;inform\u00e1ciu.<\/p>\n\n\n\n<p><strong>\u010cl\u00e1nok VI.<\/strong><\/p>\n\n\n\n<p><strong>Alternat\u00edvne rie\u0161enie sporov<\/strong><\/p>\n\n\n\n<p>6.1.&nbsp;&nbsp;Objedn\u00e1vate\u013e m\u00e1 pr\u00e1vo obr\u00e1ti\u0165 sa na Zhotovite\u013ea so \u017eiados\u0165ou o n\u00e1pravu prostredn\u00edctvom kontaktn\u00fdch \u00fadajov uveden\u00fdch v&nbsp;\u00favode t\u00fdchto OP, ak nie je napr. spokojn\u00fd so sp\u00f4sobom, ktor\u00fdm Zhotovite\u013e vybavil jeho pr\u00edpadn\u00fa reklam\u00e1ciu alebo ak sa domnieva, \u017ee Zhotovite\u013e poru\u0161il jeho pr\u00e1va.<\/p>\n\n\n\n<p>6.2.&nbsp;&nbsp;Ak Zhotovite\u013e odpovie na t\u00fato \u017eiados\u0165 zamietavo alebo na \u0148u neodpovie do 30 dn\u00ed od jej odoslania, Objedn\u00e1vate\u013e je opr\u00e1vnen\u00fd poda\u0165 n\u00e1vrh na za\u010datie alternat\u00edvneho rie\u0161enia sporu subjektu alternat\u00edvneho rie\u0161enia sporov (\u010falej ako \u201e<strong>subjekt ARS<\/strong>\u201c). Objedn\u00e1vate\u013e m\u00f4\u017ee poda\u0165 s\u0165a\u017enos\u0165 aj prostredn\u00edctvom platformy alternat\u00edvneho rie\u0161enia sporov RSO, ktor\u00e1 je dostupn\u00e1 online na&nbsp;https:\/\/ec.europa.eu\/consumers\/odr\/main\/index.cfm?event=main.home2.show&amp;lng=SK.<\/p>\n\n\n\n<p>6.4.&nbsp;&nbsp;Sp\u00f4sob alternat\u00edvneho rie\u0161enia sporov m\u00f4\u017ee vyu\u017ei\u0165 len spotrebite\u013e \u2013 fyzick\u00e1 osoba, ktor\u00e1 pri uzatv\u00e1ran\u00ed a plnen\u00ed spotrebite\u013eskej zmluvy nekon\u00e1 v r\u00e1mci predmetu svojej podnikate\u013eskej \u010dinnosti, zamestnania alebo povolania. Alternat\u00edvne rie\u0161enie sporov sa t\u00fdka v\u00fdlu\u010dne sporov vypl\u00fdvaj\u00facich zo spotrebite\u013eskej zmluvy alebo s\u00favisiacich so spotrebite\u013eskou zmluvou. Prev\u00e1dzkovate\u013e pri zachovan\u00ed z\u00e1sady minimaliz\u00e1cie uchov\u00e1vania osobn\u00fdch \u00fadajov v zmysle \u010dl. 5 ods. 1 p\u00edsm. e) Nariadenia GDPR \u00fadaje po uplynut\u00ed z\u00e1konom predpokladanej doby ich uchovania, resp. z\u00e1niku d\u00f4vodu na ich uchovanie (reklam\u00e1cia, \u017eiados\u0165, z\u00e1nik z\u00e1v\u00e4zku a&nbsp;pod.) vyma\u017ee (pozn. z\u00e1rove\u0148 m\u00f4\u017eu by\u0165 po\u010das doby uchovania anonymizovan\u00e9 a&nbsp;pod.).<\/p>\n\n\n\n<p>7.11.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Prev\u00e1dzkovate\u013e z\u00edskan\u00e9 a&nbsp;sprac\u00favan\u00e9 \u00fadaje nezverej\u0148uje.<\/p>\n\n\n\n<p>7.12.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Prev\u00e1dzkovate\u013e neuskuto\u010d\u0148uje cezhrani\u010dn\u00fd prenos osobn\u00fdch \u00fadajov.<\/p>\n\n\n\n<p>7.13.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Pr\u00e1va a povinnosti Objedn\u00e1vate\u013ea alebo tretej osoby ako dotknutej osoby:<\/p>\n\n\n\n<p>7.14.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e je povinn\u00fd uvies\u0165 iba \u00fapln\u00e9 a pravdiv\u00e9 \u00fadaje.<\/p>\n\n\n\n<p>7.15.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e sa zav\u00e4zuje, \u017ee ak poskytne osobn\u00e9 \u00fadaje tretej osoby (meno, priezvisko, telef\u00f3nne \u010d\u00edslo), rob\u00ed tak iba s jej s\u00fahlasom a dotknut\u00e1 osoba je obozn\u00e1men\u00e1 s postupmi, pr\u00e1vami a povinnos\u0165ami, ktor\u00e9 s\u00fa uveden\u00e9 na Internetovej str\u00e1nke.<\/p>\n\n\n\n<p>7.16.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Objedn\u00e1vate\u013e ako dotknut\u00e1 osoba m\u00e1 v stanovenom rozsahu pr\u00e1vo rozhodova\u0165 o nakladan\u00ed s&nbsp;jeho osobn\u00fdmi \u00fadajmi, pri\u010dom toto pr\u00e1vo m\u00f4\u017ee uplatni\u0165 u&nbsp;Prev\u00e1dzkovate\u013ea prostredn\u00edctvom kontaktn\u00fdch \u00fadajov uveden\u00fdch v&nbsp;OP.<\/p>\n\n\n\n<p>7.17.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Pr\u00e1va dotknutej osoby (pozn. m\u00e1 v\u00fdznam aj Objedn\u00e1vate\u013ea):<\/p>\n\n\n\n<p>a)&nbsp;&nbsp;Pr\u00e1vo na pr\u00edstup&nbsp;\u2013pr\u00e1vo po\u017eadova\u0165 potvrdenie o tom, \u010di sa sprac\u00favaj\u00fa osobn\u00e9 \u00fadaje do\u017eaduj\u00facej sa osoby (ak \u00e1no, k\u00f3piu t\u00fdchto mo\u017eno \u017eiada\u0165 pod\u013ea \u010dl. 15 Nariadenia GDPR, resp. \u00a7 21 z\u00e1kona; do\u017eaduj\u00faca osoba v\u0161ak m\u00f4\u017ee by\u0165 po\u017eiadan\u00e1 o konkretizovanie po\u017eiadavky, ak bude t\u00e1to nezrozumite\u013en\u00e1),<\/p>\n\n\n\n<p>b)&nbsp;&nbsp;Pr\u00e1vo na opravu&nbsp;\u2013 pr\u00e1vo po\u017eadova\u0165 o opravu neaktu\u00e1lnych\/nespr\u00e1vnych osobn\u00fdch \u00fadajov,<\/p>\n\n\n\n<p>c)&nbsp;&nbsp;&nbsp;Pr\u00e1vo na v\u00fdmaz&nbsp;\u2013 pr\u00e1vo po\u017eadova\u0165 v\u00fdmaz osobn\u00fdch \u00fadajov v pr\u00edpade odvolania s\u00fahlasu, pr\u00edpadne neexistencie pr\u00e1vneho z\u00e1kladu sprac\u00favania, alebo v pr\u00edpade, \u017ee osobn\u00e9 \u00fadaje s\u00fa sprac\u00favame nez\u00e1konne, alebo sa pominul \u00fa\u010del, pre ktor\u00fd boli osobn\u00e9 \u00fadaje sprac\u00favan\u00e9 (pozn.&nbsp;&nbsp;po\u017eiadavke nebude vyhoven\u00e9, ak \u00fadaje s\u00fa potrebn\u00e9 na preukazovanie, uplat\u0148ovanie alebo obhajovanie pr\u00e1vnych n\u00e1rokov).<\/p>\n\n\n\n<p>d)&nbsp;&nbsp;Pr\u00e1vo na obmedzenie sprac\u00favania&nbsp;\u2013 pr\u00e1vo po\u017eadova\u0165, aby bolo obmedzen\u00e9 sprac\u00favanie osobn\u00fdch \u00fadajov v pr\u00edpadoch uplatnenia niektor\u00fdch pr\u00e1v pod\u013ea tohto bodu,<\/p>\n\n\n\n<p>e)&nbsp;&nbsp;Pr\u00e1vo na prenosnos\u0165&nbsp;\u2013 v pr\u00edpade sprac\u00favania zalo\u017eenom na s\u00fahlase alebo vykon\u00e1van\u00e9ho za \u00fa\u010delom plnenia uzatvorenej zmluvy (vr. predzmluvn\u00fdch rokovan\u00ed, vyu\u017eitia kontaktn\u00e9ho formul\u00e1ra), a z\u00e1rove\u0148 vykon\u00e1van\u00e9ho automatizovan\u00fdmi prostriedkami, m\u00e1 dotknut\u00e1 osoba pr\u00e1vo obdr\u017ea\u0165 jej osobn\u00e9 \u00fadaje, ktor\u00e9 o nej boli z\u00edskan\u00e9 v be\u017ene pou\u017e\u00edvanom strojovo \u010ditate\u013enom form\u00e1te,<\/p>\n\n\n\n<p>f)&nbsp;&nbsp;&nbsp;Pr\u00e1vo namieta\u0165 vo\u010di sprac\u00favaniu&nbsp;\u2013 v pr\u00edpade sprac\u00favania osobn\u00fdch \u00fadajov z d\u00f4vodu plnenia \u00falohy realizovanej vo verejnom z\u00e1ujme alebo pri v\u00fdkone zverenej verejnej moci, alebo pokia\u013e je sprac\u00favanie vykon\u00e1van\u00e9 na z\u00e1klade opr\u00e1vnen\u00fdch z\u00e1ujmov \u010di opr\u00e1vnen\u00fdch z\u00e1ujmov tretej strany, m\u00e1 dotknut\u00e1 osoba pr\u00e1vo namieta\u0165 vo\u010di tak\u00e9muto sprac\u00favaniu. Dotknut\u00fd osoba m\u00e1 z\u00e1rove\u0148 pr\u00e1vo kedyko\u013evek namieta\u0165 proti sprac\u00favaniu osobn\u00fdch \u00fadajov na \u00fa\u010dely priameho marketingu, vr\u00e1tane profilovania v rozsahu, v akom s\u00favis\u00ed s tak\u00fdmto priamym marketingom,<\/p>\n\n\n\n<p>g)&nbsp;&nbsp;Pr\u00e1vo odvola\u0165 s\u00fahlas&nbsp;\u2013 v pr\u00edpade sprac\u00favania osobn\u00fdch \u00fadajov zalo\u017eenom na s\u00fahlase, m\u00e1 dotknut\u00e1 osoba pr\u00e1vo tento s\u00fahlas kedyko\u013evek odvola\u0165. Odvolanie s\u00fahlasu nem\u00e1 vplyv na u\u017e vykonan\u00e9 sprac\u00favanie. Ak sa kedyko\u013evek nesk\u00f4r rozhodne, \u017ee m\u00e1 z\u00e1ujem op\u00e4tovne dost\u00e1va\u0165 obchodn\u00e9 a marketingov\u00e9 ponuky o produktoch a slu\u017eb\u00e1ch, svoj odvolan\u00fd s\u00fahlas (respekt\u00edve podan\u00fa n\u00e1mietku) m\u00f4\u017ee kedyko\u013evek znovu udeli\u0165, a to ktorouko\u013evek formou kontaktu.<\/p>\n\n\n\n<p>7.18.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Ak sa Objedn\u00e1vate\u013e alebo tretia osoba domnieva, \u017ee sprac\u00favanie osobn\u00fdch \u00fadajov Prev\u00e1dzkovate\u013eom je v rozpore s Nariaden\u00edm, resp. z\u00e1konom, m\u00e1 pr\u00e1vo poda\u0165 s\u0165a\u017enos\u0165 na jeden z pr\u00edslu\u0161n\u00fdch dozorn\u00fdch org\u00e1nov, najm\u00e4 v \u010dlenskom \u0161t\u00e1te obvykl\u00e9ho pobytu, miesta v\u00fdkonu pr\u00e1ce alebo v miesta \u00fadajn\u00e9ho poru\u0161enia. Pod p\u00edsomnou formou sa rozumie aj elektronick\u00e1 po\u0161ta bez zaru\u010den\u00e9ho elektronick\u00e9ho podpisu (e-mail). V&nbsp;pr\u00edpade doru\u010dovania medzi zmluvn\u00fdmi stranami prostredn\u00edctvom po\u0161ty, sa z\u00e1sielky pova\u017euje za doru\u010den\u00fa tie\u017e, ak ju odmietne adres\u00e1t prevzia\u0165, ak ju adres\u00e1t neprevezme do 5 (piatich) dn\u00ed od jeho ulo\u017eenia u&nbsp;po\u0161tov\u00e9ho doru\u010dovate\u013ea potom, \u010do nebol adres\u00e1t zastihnut\u00fd na adrese uvedenej v&nbsp;z\u00e1v\u00e4znej objedn\u00e1vke, alebo m\u00e1rnym pokusom o doru\u010denie, ak neexistuje doru\u010dovacia adresa alebo sa adres\u00e1t nezdr\u017eiava na doru\u010dovacej adrese.
